Terms of service

1. Application

These Terms and Conditions "T&Cs" apply to all orders and contracts for the supply of goods and/or services by Corby’s Customs to the customer. No other terms, including those of the Customer, shall apply unless expressly agreed in writing by the Supplier.


2. Orders for Goods and/or Services

2.1 All quotations are subject to confirmation and are not binding offers. Orders are not binding until accepted in writing by Corby’s Customs.

2.2 By placing an order, the Customer agrees to these T&Cs. Any variation must be approved in writing by the Supplier.

2.3 The Supplier is not responsible for errors in order details supplied by the Customer.


3. Delivery and Acceptance of Goods

3.1 Estimated delivery dates are provided as a guide only. The Supplier is not liable for delays.

3.2 Delivery is made to the address provided by the Customer. If the Customer is unavailable, delivery may be left at the address at the Customer’s risk.

3.3 The Customer must inspect goods upon receipt.

3.4 Delivery does not include insurance. The Customer bears delivery costs.

3.5 Pickup is available by prior arrangement with the Supplier.


4. Price and Payment

4.1 Prices are as per the invoice and may change without notice. Prices exclude GST and delivery unless stated otherwise.

4.2 Full payment may be required prior to production or delivery.

4.3 Payment is due upon invoice unless otherwise agreed. Accepted payment methods include EFT, card, and others as specified.

4.4 Goods or services may be withheld until full payment is received.

4.5 Overdue payments will incur interest at 12% p.a., compounding monthly.

4.6 Credit card details provided via phone are not stored.

4.7 Pricing errors may be corrected and the Customer will be notified. Orders placed with incorrect pricing may be adjusted or cancelled.


5. Risk and Title

5.1 Risk passes to the Customer upon delivery or pickup.

5.2 Title remains with the Supplier until full payment is received.

5.3 Goods must be stored safely until ownership transfers. The Supplier may reclaim unpaid goods.


6. Privacy, Confidentiality, and Intellectual Property

6.1 The Supplier complies with the Privacy Act 1988 (Cth). Customer information is handled in accordance with legal requirements.

6.2 Intellectual property rights in all designs and materials remain with the Supplier.

6.3 The Customer warrants that any materials supplied to the Supplier do not infringe any third-party intellectual property.


7. Refunds

7.1 Goods must be inspected upon delivery. Claims for errors must be made within 7 days.

7.2 Refunds are available only for goods supplied incorrectly or in excess.

7.3 Refunds are not available if:

  • A claim is made after 7 days.

  • Goods were custom-made, installed, or altered.

  • Goods are not needed or incorrectly ordered.

  • Goods are not returned in original condition and packaging.

7.4 The Customer bears return shipping costs.


8. Warranty and Guarantee

8.1 Goods are warranted to be free from material or workmanship defects for 12 months. Services are warranted to be performed with due care and skill.

8.2 If a defect is found, the Supplier may repair or replace the item. Claims must be made within the warranty period.

8.3 Warranty does not apply if:

  • Goods were installed despite known compatibility issues.

  • Goods were purchased for resale.

  • Goods were misused, modified, or improperly installed.

  • The product was used outside its intended use.

8.4 Repairs/replacements will be made by the Supplier or authorised agents.

8.5 Return costs for defective items are the responsibility of the Customer.

8.6 Installation must be carried out by qualified persons. Improper installation voids warranty and may result in injury or damage.


9. Liability

9.1 The Supplier provides no guarantees beyond those required by law or expressly stated herein.

9.2 The Customer acknowledges:

  • All supplied information is accurate.

  • Goods in Supplier custody are at Customer’s risk.

  • Goods may not be compatible with non-standard uses.

  • The Supplier is not liable for consequences of modifications or non-compliant use.

  • Compliance with laws (e.g. roadworthiness) is the Customer’s responsibility.

9.3 The Supplier packages goods securely but is not liable for damage during transit.

9.4 The Supplier may refuse service if a vehicle or item is unsafe or unsuitable.

9.5 The Supplier is not responsible for indirect or consequential losses.


10. Indemnity

The Customer indemnifies the Supplier against loss, damage, and costs arising from:

  • Incorrect or misleading information.

  • Breach of contract.

  • Negligence or misuse.

  • Damage during installation or delivery.

  • Cancellations or order errors.

  • Legal claims related to the use of supplied goods.


11. Cancellation, Variation, and Termination

11.1 The Supplier may cancel an order at any time prior to delivery, with full refund of any prepayments.

11.2 Custom orders cannot be cancelled or changed once confirmed. Non-custom orders may only be modified with the Supplier’s written consent.

11.3 The Supplier may terminate a contract for non-payment or breach of these T&Cs.

11.4 Upon termination, all outstanding payments become immediately due.

11.5 These terms remain in effect even after contract termination.


12. Loan Vehicle (If Applicable)

If a loan vehicle is provided, the Customer must agree to and follow the Supplier’s separate Loan Vehicle Agreement, in addition to these T&Cs.


13. Miscellaneous

13.1 These T&Cs:

  • May only be amended in writing by the Supplier.

  • Do not limit the Supplier’s statutory rights.

  • Remain enforceable despite any failure to enforce rights immediately.

  • May be updated without prior notice.

13.2 These T&Cs are governed by the laws of Western Australia. Disputes are subject to WA courts.

13.3 If any clause is found unenforceable, the remaining provisions remain valid.


Definitions

  • Supplier: Corby’s Customs, its employees, agents, or authorised representatives.

  • Customer: The individual or business purchasing goods or services.

  • Goods: Items supplied by Corby’s Customs.

  • Services: Work or labour provided by Corby’s Customs.

  • Order: A confirmed request for goods or services.

  • Price: The total payable for goods and/or services.

  • Intellectual Property Rights: Copyrights, trademarks, and all proprietary rights.


Declaration

By placing an order, the Customer acknowledges they have read, understood, and agreed to these Terms and Conditions, and that they have had the opportunity to seek independent legal or financial advice.
